Membership

1. Memberships: Your first month at SunstoneFIT is prorated, contingent upon when this Agreement is initiated relative to the first or 15th of each month (unless a different monthly automatic renewal date is specifically requested). Monthly Dues are only prorated once, upon initial enrollment. Monthly Memberships are perpetual until cancelled as per cancellation policy.
2. Membership Payments: All memberships are collected via auto-debit (i.e., electronic funds transfer) from either a checking account, debit card or credit card. By providing your payment information you allow SunstoneFIT to automatically withdraw dues and fees as they come due each month.
3. Membership Changes: All changes must be made in writing via www.sunstoneFIT.com/service 1 month prior to the Auto-Debit Cycle Date
4. Contract Fulfillment: Memberships with 6-month and 12-month contracts may only be fulfilled by payment of active months. Months when the membership is on "hold" do not count towards the contract term. In lieu of contract fulfillment, members may opt to buy out their contract with a $175 early cancellation fee.
5. Continuation of Memberships: After completion of contract term, 6-month and 12-month memberships will automatically become month-to-month. All memberships will continue until the member makes a written change request via www.sunstonefit.com/service
6. Add-A-Family Memberships: Family is defined as spouse filing jointly and/or children declared as dependents (as per IRS rules) living in the same household.
7. Coach-for-Life Memberships: Private Training sessions that have been accrued or purchased do not expire. At the time of cancellation, any unused Private Training will remain on your account for use at any time. Any unpaid Private Training will be charged to the payment information on file at the rate appropriate to your CFL quarterly ($75/hr) or monthly ($65/hr) membership.
   1. Quarterly CFL memberships accrue 20 minutes of Private Training each month.
   2. Monthly CFL memberships accrue 60 minutes of Private Training each month.
   3. CFL members may purchase additional Private Training at any time at the discounted rate of $75/hr for quarterly CFL members and $65/hr for monthly members
8. Right to Modify Dues: SunstoneFIT may increase its Dues at any time. Memberships will be given 30 days advance notice of any changes to Dues.
9. Non-solicitation Agreement: In consideration of being a member at SunstoneFIT, all members (whether on a monthly membership or single class) agree not to solicit members or employees with other services or products on SunstoneFIT premises or at SunstoneFIT sponsored events without the express written approval by SunstoneFIT. Furthermore, if a member does conduct solicitation and such solicitation results in monetary damages, then SunstoneFIT shall have the right to pursue all legal remedies to recover such damages. Damages may include, but not be limited to, lost sales, other lost income, and related legal fees and expenses.

Three-Day Right of Rescission

New members have three days after signing this Agreement to cancel their membership without penalty. If the Agreement is cancelled within three days, SunstoneFIT will return to the member within thirty days all amounts paid less any payments due for actual services used/rendered. A charge equivalent to our current drop-in rate will be charged for each day attended during those three days. To cancel, new members must inform SunstoneFIT in writing via www.sunstonefit.com/service of their intent to cancel.

Availability and Condition of Facility

1. Class or by Appointment Only: SunstoneFIT does not provide an "Open Gym" facility. Members may use the facilities only during scheduled classes, scheduled events or by appointment with a coach. Operating hours and current class schedules are listed on our website at www.sunstoneFIT.com. SunstoneFIT reserves the right to change operating hours and/or class schedules at its sole discretion without any effect to this Agreement.
2. Limited Availability: SunstoneFIT may close its facility for seminars, certifications, maintenance, selected holidays and other hours based on municipal requirements. SunstoneFIT may delete, change, discontinue, repair, or replace any part or all of the Facility without any effect on this Agreement.
3. Limited Use: If you know or should know you have a problem that might prevent you from using SunstoneFIT (i.e., medical or family emergency, business travel, vacation, etc…) and you sign this Agreement; you agree that your membership is limited accordingly. However, because this is your choice, you still must pay your monthly dues as if you could use the Facility; there will be no carry-over of monthly dues into subsequent months for any time unspent using the Facility in a previous month. 4. Use of Facility: By signing this membership agreement and continuing your membership you hereby agree that the facility and all its amenities are satisfactory. Amenities include but are not limited to yoga/fitness rooms, lobby, common areas, locker rooms, bathrooms, showers, parking and driveway. Member hereby waives their right to claim that the facilities are inadequate or unsuitable for use. Member agrees to use facilities and all amenities as is and assumes any potential risk associated with such use.

Hold Policy for Memberships

Members may put their membership on hold, in one month increments (based on their Auto-Debit Cycle Date), for an unlimited amount of time for a fee of $10 per month. Notice of hold must be given 1-month written notice via www.sunstonefit.com/service prior to the Auto-Debit Cycle Day. Months on Hold do not count towards fulfillment of contracts

On Account Payments

SunstoneFIT may charge members’ method of payment on file for any on account balances.

Cancellation of Membership by Member

A member may cancel his/her membership at any time with at least 1 month written notice prior to their next Auto-Debit cycle date. Partial months are not permitted. There are no refunds for paid membership fees, and SunstoneFIT will not prorate a cancelled membership.
